It was a pleasure to present at Japan International Cooperation Agency (JICA) in Tokyo recently as part of a session on Collaborative Contracting with NEC4.

We explored how NEC’s emphasis on proactive contract management, early warning, programme management and the early resolution of change and risk differs from more traditional approaches to contract administration.

We also looked at the evolution of FIDIC from the 1999 to 2017 editions, and how FIDIC has itself moved towards more proactive management and dispute avoidance, while retaining a different contractual structure and philosophy from NEC.

A particularly interesting part of the discussion was how these approaches translate to major international projects, where successful collaborative contracting ultimately depends not only on the form of contract selected, but on the willingness and capability of the parties to administer it as intended.
